Terms of Enrolment
Effective 1 July 2025 – Compliant with Standards for RTOs 2025
1. Introduction
These Terms of Enrolment form a legally binding agreement between you (the student or enrolling party) and the Australian College of Weight Management & Allied Health (ACWMAH), Registered Training Organisation (RTO) No. 45052, ABN 16 605 382 956.
By submitting your enrolment form, whether electronically or in writing, you agree to be bound by these Terms, the Student Handbook, and all applicable ACWMAH policies.
These Terms comply with the Outcome Standards for NVR Registered Training Organisations Instrument 2025, the National Vocational Education and Training Regulator Act 2011 (NVETR Act), the Privacy Act 1988 (Cth), and other relevant legislation.
2. Enrolment Process and Confirmation
2.1 Application and Acceptance
- You must complete and submit the official ACWMAH enrolment form.
- Enrolment applications may be submitted online or by paper form.
- Enrolment is subject to meeting course-specific entry requirements, including successful completion of any Language, Literacy, Numeracy and Digital Literacy (LLND) assessments where required.
2.2 Confirmation of Enrolment
- Enrolment is confirmed when ACWMAH issues a written Confirmation of Enrolment, which will include details of the course, fees, payment arrangements, and student support services.
- Until confirmation is issued, no binding contract exists.
3. Entry Requirements
3.1 General Requirements
- You must meet the essential entry criteria for your selected course as published in the course information materials.
- This may include prerequisites such as prior qualifications, age requirements, and basic computer/internet literacy.
3.2 Specific Course Requirements
- Some courses require prior completion of related qualifications (e.g., Certificate IV or higher in a similar or related field).
- You must have access to the necessary technology to participate in online delivery (e.g., computer, internet access).
3.3 LLND Support
- ACWMAH will assess your LLND skills to ensure you can successfully engage with the course materials.
- Where support is needed beyond ACWMAH’s scope, referrals may be made to external providers (at your cost).
4. Student Rights and Responsibilities
4.1 Your Rights
- To receive training, assessment, and support services that meet the RTO Standards and regulatory requirements.
- To be treated fairly, respectfully, and without discrimination or harassment.
- To have your personal information handled confidentially and in accordance with privacy laws.
- To access your records and results in a timely manner.
- To make complaints and appeals without reprisal.
- To receive quality training and assessment that meets the requirements of the Outcome Standards for NVR Registered Training Organisations Instrument 2025.
- To be informed about any changes to agreed services, including in relation to any new third-party arrangements or changes to existing third-party arrangements for the delivery of services.
4.2 Your Responsibilities
- To provide true, accurate, and complete information during enrolment and throughout your study.
- To attend and actively participate in learning and assessment activities.
- To comply with all ACWMAH policies and the Code of Conduct.
- To honour your financial obligations, including payment of fees and charges.
- To maintain communication with ACWMAH regarding any changes in contact or personal circumstances.
- To respect the rights of other students, staff, and any third parties involved in the delivery of your training.
5. Fees, Payment and Refunds
5.1 Fees and Charges
- Full details of all fees, charges, and payment methods will be provided prior to enrolment.
- You agree to pay the course fees according to the payment plan or invoice issued.
- ACWMAH will not require a prospective or current student to prepay fees in excess of $1,500 at any time for services yet to be delivered, in accordance with the requirements of the Outcome Standards for NVR Registered Training Organisations Instrument 2025.
5.2 Payment Plans
- Payment plans are available subject to approval.
- See Section 6 for specific payment plan terms for Stripe customers.
5.3 Refunds, Withdrawals and Orientation Period
- ACWMAH provides a 7-day orientation period from the date of enrolment during which you may withdraw and receive a refund, less a $250 withdrawal administration fee.
- Withdrawals after the orientation period will not be eligible for a refund unless otherwise specified in ACWMAH’s Refund Policy.
- All withdrawal requests must be submitted in writing and processed according to ACWMAH procedures.
- In the event that ACWMAH cancels a course before it commences, students will be offered a full refund or the opportunity to transfer to another course.
- In the event that ACWMAH is unable to continue offering a course after it commences, students will be offered a refund of tuition fees for the portion of the course not completed or the opportunity to transfer to another course.
5.4 Statutory Cooling-Off Period
- In compliance with the Outcome Standards for NVR Registered Training Organisations Instrument 2025, ACWMAH informs you of your rights under the Australian Consumer Law (ACL) regarding statutory cooling-off periods.
- The ACL defines a statutory cooling-off period as a specified timeframe of 10 business days during which a consumer who entered into a contract following unsolicited marketing or sales tactics has the legal right to withdraw from the contract with little or no penalty.
- This statutory cooling-off period is separate from and may extend beyond ACWMAH’s own 7-day orientation period but applies only in circumstances involving unsolicited sales or marketing approaches.
- If you believe your enrolment contract was entered into through unsolicited marketing, you may be entitled to exercise this statutory cooling-off right. For further information, please contact ACWMAH or seek independent advice.
6. Payment Plans & Failed Payment Policy (Stripe Customers)
6.1 Payment Processing
- ACWMAH utilises Stripe as its secure payment gateway for processing tuition fees and payment plan instalments.
- All transactions are subject to Stripe’s terms of service and privacy policy, which can be accessed at: https://stripe.com/au/legal and https://stripe.com/au/privacy.
6.2 Failed Payments and Dishonour Fees
- If you are enrolled in a payment plan and a payment attempt fails, a dishonour fee of $10.00 will be applied.
- Stripe will automatically re-attempt payment up to 8 times over a two-week period following the initial failure.
- ACWMAH may also manually re-attempt payment on any business day during this period.
6.3 Additional Dishonour Fee Rules
- Only the first dishonour in any two-week cycle will incur the $10.00 fee. Subsequent failed re-tries within the same two-week cycle will not incur additional dishonour fees.
- Dishonour fees will be invoiced at the point where arrears reach the third and seventh accumulated failed payments. These invoices will be payable immediately.
- When a dishonour fee invoice is generated, a manual retry of the outstanding amount will be processed at that time.
6.4 Customer Obligations
You are responsible for ensuring that:
- Your nominated payment method has sufficient funds at each scheduled payment date.
- Your card details remain valid and up to date.
- Any changes to your billing details are provided to ACWMAH in writing at least three business days before the next scheduled debit.
6.5 Collection of Overdue Amounts
In the event of persistent failed payments, ACWMAH reserves the right to:
- Suspend access to learning resources until the account is brought up to date
- Engage debt recovery services, which may result in additional costs being payable by you
- Report payment defaults to a credit reporting body in accordance with section 11 of these terms
6.6 Security and Data Privacy
- Payment details are processed and stored securely by Stripe and are not retained in any ACWMAH systems.
- All payment data is encrypted and managed in compliance with the Payment Card Industry Data Security Standard (PCI DSS).
7. Course Progress and Completion
- You are expected to progress through your course within the agreed timeframe.
- Extensions may be granted on written application for compassionate or compelling reasons, subject to approval.
- Failure to progress or comply with course requirements may result in cancellation of enrolment.
- ACWMAH will monitor your course progress and provide support strategies if you are at risk of not completing within the expected timeframe.
8. Deferral, Suspension, and Cancellation of Enrolment
- Deferrals or suspensions may be granted in exceptional circumstances and require a formal written request.
- Enrolment may be cancelled by ACWMAH for non-payment, misconduct, breach of policies, or failure to meet course requirements.
- You have the right to appeal any cancellation decision.
- ACWMAH will provide written notification of intention to suspend or cancel enrolment and advise of your right to appeal.
9. Complaints and Appeals
9.1 Internal Complaints and Appeals Process
- ACWMAH maintains a fair, transparent complaints and appeals process available to all students in accordance with Division 5 – Feedback, complaints and appeals – 2.7 of the Outcome Standards for NVR Registered Training Organisations Instrument 2025.
- Complaints or appeals should be lodged in writing using the prescribed forms.
- All matters will be treated confidentially and without reprisal.
- ACWMAH will acknowledge receipt of all complaints and appeals within 5 business days and commence assessment of the complaint or appeal within 10 business days.
- ACWMAH will ensure that the assessment of the complaint or appeal is conducted in a professional, fair and transparent manner.
- The complainant or appellant will be provided with a written statement of the outcome, including details of the reasons for the outcome.
- The formal complaints and appeals process will be at no cost to the student.
9.2 External Complaints and Appeals Options
If you are not satisfied with the outcome of the internal complaints and appeals process, you have the right to access external complaint and appeal processes. These include:
Queensland Training Ombudsman
The Queensland Training Ombudsman provides a free, confidential, and independent service to review and resolve enquiries and complaints from apprentices, trainees, students, employers and other stakeholders about the VET system.
The Queensland Training Ombudsman can:
- Help you navigate the complex VET sector
- Find the best way to address your concerns
- Provide free and impartial advice about rights and responsibilities within the VET sector
- Review your issue and recommend the most appropriate action
- Refer the complaint to another agency if they are best suited to assist
- Mediate between parties to come to a mutually beneficial solution

10. Recognition of Prior Learning (RPL) and Credit Transfer
10.1 Recognition of Prior Learning (RPL)
- ACWMAH offers Recognition of Prior Learning (RPL) to all students prior to enrolment.
- RPL is an assessment process that assesses your competency—acquired through formal and informal learning—to determine if you meet the requirements for a unit of study.
- RPL may reduce the amount of training you need to undertake to achieve a qualification.
- Fees apply for RPL assessment and will be advised prior to commencement of the process.
10.2 Credit Transfer
- ACWMAH recognises AQF qualifications and Statements of Attainment issued by other RTOs.
- Credit transfer means you receive credit for units you have previously completed and are recognised by ACWMAH.
- There is no charge for credit transfer applications.
- You must provide certified copies of qualifications or statements of attainment when applying for credit transfer.
11. Privacy Notice
Why we collect your personal information
As a registered training organisation (RTO), we collect your personal information so we can process and manage your enrolment in a vocational education and training (VET) course with us.
How we use your personal information
We use your personal information to enable us to deliver VET courses to you, and otherwise, as needed, to comply with our obligations as an RTO.
How we disclose your personal information
We are required by law (under the National Vocational Education and Training Regulator Act 2011 (Cth) (NVETR Act)) to disclose the personal information we collect about you to the National VET Data Collection kept by the National Centre for Vocational Education Research Ltd (NCVER). The NCVER is responsible for collecting, managing, analysing and communicating research and statistics about the Australian VET sector.
We are also authorised by law (under the NVETR Act) to disclose your personal information to the relevant state or territory training authority.
How the NCVER and other bodies handle your personal information
The NCVER will collect, hold, use and disclose your personal information in accordance with the law, including the Privacy Act 1988 (Cth) (Privacy Act) and the NVETR Act. Your personal information may be used and disclosed by NCVER for purposes that include populating authenticated VET transcripts; administration of VET; facilitation of statistics and research relating to education, including surveys and data linkage; and understanding the VET market.
The NCVER is authorised to disclose information to the Australian Government Department of Employment and Workplace Relations (DEWR), Commonwealth authorities, State and Territory authorities (other than registered training organisations) that deal with matters relating to VET and VET regulators for the purposes of those bodies, including to enable:
- administration of VET, including program administration, regulation, monitoring and evaluation
- facilitation of statistics and research relating to education, including surveys and data linkage
- understanding how the VET market operates, for policy, workforce planning and consumer information.
The NCVER may also disclose personal information to persons engaged by NCVER to conduct research on NCVER’s behalf.
The NCVER does not intend to disclose your personal information to any overseas recipients.

DEWR is authorised by law, including the Privacy Act and the NVETR Act, to collect, use and disclose your personal information to fulfil specified functions and activities. 12. Consent to Credit Check
By accepting these Terms of Enrolment, you acknowledge and agree to the following:
12.1 For Companies (Body Corporate)
If you are applying for enrolment on behalf of a company or incorporated entity, the Australian College of Weight Management & Allied Health (ACWMAH) reserves the right to obtain a commercial credit report about your organisation.
This credit assessment may be used to evaluate the organisation’s ability to meet financial obligations under the enrolment agreement and any related payment arrangements.
12.2 For Individuals (Natural Persons)
By agreeing to these terms, you:
a. Acknowledgement of the Privacy Act
Understand that, under the Privacy Act 1988 (Cth), ACWMAH may disclose certain personal information to a credit reporting body (CRB).
This may include information that identifies you, the fact that you have applied for credit, the amount of credit sought, that ACWMAH is a current credit provider to you, details of payments that are overdue, and information relating to serious credit infringements (e.g., fraudulent behaviour or clear intention not to meet payment obligations).
b. Purpose of Credit Reporting
Consent to ACWMAH obtaining a credit report from a CRB about your personal creditworthiness for the purpose of: i. Assessing your enrolment application and any payment plan request; and ii. Assisting in the collection of overdue amounts.
c. Commercial Credit Information
Consent to ACWMAH obtaining information about your commercial activities or commercial creditworthiness from:
- Any business or service that provides commercial credit information
- Your accountant or other nominated financial professional
- Any supplier to you
d. Exchange of Information with Other Credit Providers
Consent to ACWMAH providing to and obtaining from other credit providers (named in your application or in a credit report issued by a CRB) information about your credit arrangements for the purposes of: i. Assessing your application; ii. Notifying them of any default by you; iii. Allowing another credit provider to determine the status of your arrangements with ACWMAH if you are in default with them; iv. Generally assessing your creditworthiness.
e. Scope of Information
Understand that the information exchanged can include details about your:
- Personal and/or commercial creditworthiness
- Credit standing
- Credit history
- Credit capacity
- Any other information permitted under the Privacy Act 1988 (Cth) to be exchanged between credit providers and CRBs.
13. Third-Party Arrangements
- ACWMAH may enter into arrangements with third parties for the delivery of training and assessment or related services.
- You will be notified before enrolment of any third-party arrangements that will affect the services provided to you, including:
- The identity and contact details of any third party that will provide training and/or assessment
- Your rights, including that you can contact ACWMAH directly if you have any concerns about the services provided
- Any additional requirements or costs associated with third-party arrangements
- ACWMAH remains responsible for the quality of training and assessment provided by any third party.
- ACWMAH will ensure that any third party delivering services on its behalf is required under written agreement to cooperate with the VET Regulator.
14. Access and Equity
- ACWMAH is committed to providing training opportunities to all people on an equal and fair basis.
- All students have equal access to training programs irrespective of their gender, culture, linguistic background, race, socio-economic background, disability, age, marital status, pregnancy, sexual orientation, or carer’s responsibilities.
- ACWMAH will make reasonable adjustments to training and assessment processes, where possible, to ensure that all students have the opportunity to successfully complete their training.
15. Work Health and Safety
- ACWMAH is committed to providing a safe and healthy learning environment.
- You must take reasonable care of your own health and safety and that of others who may be affected by your actions or omissions.
- You must comply with any reasonable instruction given by ACWMAH in relation to health and safety.
- You must report any safety concerns, accidents, or incidents to ACWMAH staff immediately.
16. Disclaimer and Limitation of Liability
- ACWMAH makes all reasonable efforts to ensure information and training are accurate at the point of delivery.
- You acknowledge that ongoing competency and application of knowledge post-assessment is your responsibility.
- ACWMAH excludes liability for any loss or damage arising from your application of course knowledge beyond the training context.
- To the extent permitted by law, ACWMAH’s liability for breach of any implied warranty or condition that cannot be excluded is restricted to:
- The re-supply of services; or
- The payment of the cost of having services re-supplied.
17. Governing Law and Jurisdiction
- These Terms of Enrolment are governed by the laws of the State of Queensland, Australia.
- Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Queensland.
18. Changes to Terms
- ACWMAH reserves the right to update or modify these Terms of Enrolment at any time.
- Students will be notified of any changes that may affect their enrolment.
- The most current version of the Terms of Enrolment will be available on the ACWMAH website.
